Terms of Service

1. Agreement to Terms

By accessing or using LangPal ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

LangPal is operated by CodeYourBrand Sp. z.o.o (NIP: PL5273088516), located at UL. ALEJE JEROZOLIMSKIE 109/70, 02-011 WARSZAWA, Poland.

2. Use of Service

2.1 Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this age requirement.

2.2 Account Registration

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

2.3 Prohibited Activities

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service
  • Upload malicious code or content
  • Use automated systems to access the Service without permission
  • Share your account credentials with others
  • Use the Service to infringe on others' intellectual property rights

3. Your Content

3.1 Ownership

You retain ownership of the vocabulary lists, words, and other content you create using the Service ("Your Content").

3.2 License

By using the Service, you grant us a limited license to process Your Content to provide the Service, including:

  • Storing and displaying your vocabulary lists
  • Processing your words through OpenAI's API to generate definitions, synonyms, antonyms, and example sentences
  • Generating pronunciation audio through ElevenLabs

3.3 Shared Lists

If you share a vocabulary list via a share link, others with that link can view the content. You are responsible for managing who has access to your share links.

4. Payment Terms

4.1 Subscription

LangPal offers a freemium model. Free users are limited to 1 vocabulary list and 25 words. Premium features require a paid subscription processed through Stripe.

4.2 Refunds

All payments are non-refundable. Once a payment is processed, we do not offer refunds except where required by applicable law.

4.3 Cancellation

You may cancel your subscription at any time. Your premium access will continue until the end of your current billing period.

5. Intellectual Property

5.1 Our Property

The Service, including its original content (excluding Your Content), features, and functionality, is owned by CodeYourBrand Sp. z.o.o and is protected by intellectual property laws.

5.2 Trademarks

LangPal and associated logos are trademarks of CodeYourBrand Sp. z.o.o. You may not use these without our prior written consent.

6. Privacy

Your use of the Service is also governed by our Privacy Policy. Please review it to understand how we collect and use your information.

7. Disclaimers

7.1 "As Is" Service

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.

7.2 AI-Generated Content

Word definitions, synonyms, antonyms, and example sentences are generated by artificial intelligence (OpenAI). While we strive for accuracy, we do not guarantee the correctness of AI-generated content. Users should verify important information independently.

7.3 No Guarantee

We do not guarantee that:

  • The Service will meet your specific requirements
  • The Service will be uninterrupted, timely, or error-free
  • Results from using the Service will be accurate or reliable

8. Limitation of Liability

To the maximum extent permitted by law, CodeYourBrand Sp. z.o.o shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from:

  • Your use or inability to use the Service
  • Any unauthorized access to your data
  • Any third-party conduct on the Service
  • Any other matter relating to the Service

9. Indemnification

You agree to indemnify and hold harmless CodeYourBrand Sp. z.o.o, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights

10. Copyright Policy

We respect intellectual property rights. If you believe any content on the Service infringes your copyright, please contact us at matt@codeyourbrand.com with:

  • A description of the copyrighted work
  • The location of the allegedly infringing content
  • Your contact information
  • A statement of good faith belief that the use is not authorized

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe:

  • Violates these Terms
  • Is harmful to other users or third parties
  • Is fraudulent or illegal

Upon termination, your right to use the Service will immediately cease.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Service and updating the "Last updated" date.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Warsaw, Poland.
